Intellectual Property Policy

1. Brand Owner

TRAINTORQUIX is a brand operated by ZAID & IBRAHIM LIMITED. References to “TRAINTORQUIX”, “we”, “us” or “our” mean the TRAINTORQUIX brand and, where applicable, ZAID & IBRAHIM LIMITED.
This policy is intended to protect the TRAINTORQUIX brand and also to respect the intellectual property rights of other businesses, creators and rights holders.

2. Intellectual Property Covered by this Policy

This policy covers trademarks, trade names, logos, slogans, website text, product descriptions, product images, product videos, manuals, packaging artwork, product listings, design files, graphics, icons, photographs, advertising materials, social media content, databases, software, website layout, digital downloads, product instructions and all other materials connected with TRAINTORQUIX.
It also covers any product designs, packaging designs, technical drawings, manufacturing specifications, brand guidelines and other confidential or proprietary materials created for or owned by TRAINTORQUIX.

3. Ownership of TRAINTORQUIX Intellectual Property

Unless expressly stated otherwise, all TRAINTORQUIX intellectual property is owned by, licensed to, or controlled by TRAINTORQUIX or ZAID & IBRAHIM LIMITED.
No part of the TRAINTORQUIX website, brand materials, product materials or marketing content may be copied, reproduced, modified, published, distributed, transmitted, displayed, sold, licensed or used commercially without prior written permission.

4. Trademark Protection

You may not register, use or attempt to register domain names, social media handles, marketplace shop names, paid search keywords, business names or product names that include TRAINTORQUIX or a confusingly similar variation.

5. Copyright Protection

Website text, product descriptions, product photographs, videos, manuals, guides, graphics, packaging artwork, downloadable materials and marketing content are protected by copyright and other applicable laws.
You may not scrape, copy, reproduce, republish, translate, modify, distribute or commercially exploit our copyrighted materials without permission.
Limited personal use, such as viewing product instructions for your purchased product or sharing a genuine product review, is permitted where it does not mislead others or harm the TRAINTORQUIX brand.

6. Product Design, Packaging and Creative Assets

Product designs, packaging layouts, labels, visual presentation, manuals, artwork, product images and promotional content may be protected by copyright, trademark, trade dress, design rights and other laws.
You may not copy, imitate, reverse engineer, reproduce or manufacture products, packaging or marketing materials that are intended to look like TRAINTORQUIX products or mislead customers into believing they are connected with TRAINTORQUIX.
Counterfeit products, lookalike branding and misleading product listings are strictly prohibited.

7. Permitted Personal Use

Customers may use TRAINTORQUIX materials for personal, non-commercial purposes connected with their genuine use of TRAINTORQUIX products, such as reading manuals, saving care instructions or posting genuine personal reviews.
Any such use must be accurate, lawful, non-misleading and must not suggest official approval, sponsorship or partnership unless we have confirmed this in writing.

8. Commercial Use Restrictions

Commercial use of TRAINTORQUIX intellectual property requires written permission. 9. Online Marketplace and Reseller Policy

Unauthorized use of TRAINTORQUIX brand assets on Amazon, Walmart, eBay, Etsy, Shopify, TikTok Shop, Facebook Marketplace, Instagram Shop or any other sales channel is prohibited.
You may not create product listings that use TRAINTORQUIX images, text, logos or brand names unless you are an authorized seller and the listing is accurate, genuine and approved where required.
We may report unauthorized listings, counterfeit products, misleading listings, brand misuse and suspected infringement to marketplaces, payment processors, search engines, hosting companies and relevant authorities.

10. Counterfeit and Infringing Products

We take counterfeit products and brand misuse seriously. Products that falsely use the TRAINTORQUIX brand, copy TRAINTORQUIX packaging, imitate our product presentation or mislead customers may be reported and removed.
We reserve the right to take enforcement action against manufacturers, sellers, distributors, importers, advertisers and third parties involved in infringing or counterfeit activity.

11. User-Generated Content

If you submit reviews, photographs, videos, testimonials, comments or other content relating to TRAINTORQUIX products, you confirm that you own or have permission to provide that content and that it does not infringe the rights of others.
By submitting such content, you grant TRAINTORQUIX a non-exclusive, worldwide, royalty-free, transferable and sublicensable licence to use, reproduce, display, edit, publish and distribute that content for marketing, promotional, customer support and business purposes.
We may remove user-generated content that is misleading, unlawful, infringing, offensive, fraudulent or inconsistent with our brand standards.

12. Social Media Sharing

Customers may share genuine product experiences on social media provided the content is truthful, lawful and does not misrepresent a relationship with TRAINTORQUIX.
Use of our brand assets in sponsored content, paid promotions, affiliate marketing or commercial campaigns requires prior written approval unless covered by an existing written agreement.

13. No AI Training, Scraping or Dataset Use

You may not use TRAINTORQUIX website content, images, product descriptions, manuals, data, reviews, videos or other materials for AI training, machine learning datasets, scraping, automated extraction, data mining, competitive databases or commercial content generation without our written permission.
Automated crawling that violates website terms, security controls, robots instructions or applicable law is prohibited.

14. Third-Party Intellectual Property

TRAINTORQUIX respects the intellectual property rights of others. If we use third-party trademarks, logos, product references or brand names, they remain the property of their respective owners.
Reference to a third-party brand does not imply endorsement, sponsorship or affiliation unless clearly stated.

15. Reporting Intellectual Property Infringement

If you believe content on our website or platform infringes your intellectual property rights, please contact us with enough information for us to investigate.
Your notice should include: your name and contact details, identification of the intellectual property you claim is infringed, proof of ownership or authorization, the location of the allegedly infringing material, a statement that you believe the use is unauthorized, and any supporting documents.

16. DMCA Notice for U.S. Copyright Complaints

For copyright complaints involving the United States, your notice should include the information required by the Digital Millennium Copyright Act (DMCA), including identification of the copyrighted work, the allegedly infringing material, your contact details, a good-faith statement, a statement under penalty of perjury that the information is accurate, and your physical or electronic signature.
If we receive a valid copyright notice, we may remove or disable access to the relevant content and may notify the person who posted it.

17. Counter-Notification

If your content has been removed due to a copyright complaint and you believe this was a mistake or misidentification, you may submit a counter-notification where permitted by law.
A valid counter-notification should include your contact details, identification of the removed material, a statement under penalty of perjury that you believe the removal was due to mistake or misidentification, consent to the relevant jurisdiction where required, and your physical or electronic signature.

18. Repeat Infringer Policy

Where appropriate, we may suspend or terminate access, accounts, reseller privileges or other relationships with parties who repeatedly infringe intellectual property rights or misuse TRAINTORQUIX intellectual property.

19. Enforcement and Remedies

TRAINTORQUIX may take any lawful action to protect its intellectual property, including sending takedown notices, reporting marketplace violations, requesting search engine removal, notifying payment processors, contacting hosting providers, pursuing legal claims and seeking damages, injunctions, costs and other remedies where available.
Failure to enforce any right immediately does not mean we waive that right.

20. International Protection

TRAINTORQUIX intellectual property may be protected under U.S., UK, EU and international copyright, trademark, design, trade dress, unfair competition and related laws.
Customers and third parties outside the United States are also expected to comply with this policy and all applicable local laws.

21. No Transfer of Rights

Purchasing a TRAINTORQUIX product does not transfer ownership of any TRAINTORQUIX intellectual property. You receive only the right to use the purchased product for its intended purpose.
Nothing in this policy grants any licence, ownership, assignment or right to use TRAINTORQUIX intellectual property except as expressly stated.
