User-Generated Content Policy

1. Purpose and Scope

This Policy applies when you submit, upload, tag, mention, review, post, share or otherwise provide content relating to TRAINTORQUIX, our products, our website, our social media accounts, our email campaigns, our advertising, our promotions or our customer community. It applies globally, subject to mandatory local laws.

2. What Counts as User-Generated Content

User-generated content, also called UGC, includes any content created or provided by customers, website users, reviewers, affiliates, social media users, competition entrants or other third parties.
· Product reviews and ratings.
· Photos or videos of TRAINTORQUIX products.
· Testimonials, stories, comments and feedback.
· Social media posts, tags, hashtags and mentions.
· Before-and-after content, training clips and product demonstration content.
· Questions, answers, forum posts or community submissions.
· Competition, giveaway or promotional entries.

3. Community Principles

TRAINTORQUIX encourages honest, respectful and useful content. We welcome genuine customer experiences, including constructive criticism, provided the content complies with this Policy and applicable law.
· Respect: content should not attack, abuse, harass or discriminate against others.
· Honesty: reviews and testimonials should reflect real experiences.
· Safety: content should not encourage unsafe, dangerous or improper use of products.
· Ownership: users should submit only content they own or have permission to share.

4. Ownership of Your Content

You retain ownership of the content you submit. Submitting content to TRAINTORQUIX does not transfer copyright ownership to us. However, by submitting content, tagging TRAINTORQUIX, responding to our content request, using our branded hashtags, uploading content to our website, or otherwise giving us permission, you grant TRAINTORQUIX the licence described below.

5. Licence Granted to TRAINTORQUIX

By submitting or authorising the use of UGC, you grant TRAINTORQUIX, ZAID & IBRAHIM LIMITED, and our affiliates, service providers, advertising partners and marketplace partners a worldwide, non-exclusive, royalty-free, transferable, sublicensable licence to use, reproduce, display, publish, edit, crop, adapt, translate, distribute and otherwise use your UGC for lawful business, marketing, promotional, operational and customer service purposes.
· Our website and product pages.
· Social media accounts and paid social media advertising.
· Email marketing and newsletters.
· Digital advertising, including Google, Meta and similar platforms.
· Marketplace listings, where permitted, including Amazon, Walmart, eBay, Etsy and other platforms.
· Printed or digital marketing material.
· Customer support, internal training, fraud prevention and quality control.

6. No Payment or Obligation to Publish

Unless separately agreed in writing, you will not be entitled to payment, royalties, commission or other compensation for our use of your UGC. Submitting content does not guarantee that it will be published, displayed or used. We may remove, decline, edit or stop using UGC at any time.

7. Permission from People Appearing in Content

If your UGC includes another person, you confirm that you have obtained that person’s permission for the content to be submitted and used under this Policy. This is especially important for photos, videos, testimonials and social media posts that show identifiable individuals. You must not submit images or videos of children unless you are the child’s parent or legal guardian and you have authority to give permission.

8. User Warranties

By submitting UGC, you confirm that:
· The content is your original work or you have the right to submit it.
· The content does not infringe copyright, trademark, privacy, publicity or other rights of any third party.
· The content is accurate to the best of your knowledge and is not misleading.
· The content does not contain unlawful, harmful, defamatory, abusive or offensive material.
· The content does not contain confidential information belonging to someone else.
· The content complies with applicable advertising, consumer protection and endorsement rules.

9. Prohibited Content

You must not submit, upload or share UGC that includes:
· Illegal content or content encouraging unlawful activity.
· Hate speech, discriminatory comments, harassment, bullying or threats.
· Violence, self-harm, dangerous behaviour or unsafe exercise practices.
· Nudity, sexually explicit material or exploitative content.
· False, misleading, fake or incentivised reviews not properly disclosed.
· Medical claims, cure claims or unsupported health claims.
· Spam, scams, phishing attempts, malware or malicious links.
· Content that infringes copyright, trademarks, design rights or privacy rights.
· Counterfeit product promotion or unauthorised resale claims.
· Personal data of another person without permission.
· Content that damages or misrepresents TRAINTORQUIX, our products or our customers.

10. Product Reviews and Testimonials

Reviews and testimonials must be based on genuine experiences. TRAINTORQUIX may verify reviews, request order details, remove duplicate or suspicious reviews, and reject reviews that appear fake, misleading, abusive or unrelated to the product. If you received a discount, free product, payment or other benefit in exchange for content, you must clearly disclose that relationship where required by law.

11. Health, Fitness and Safety Content

UGC showing exercise or product use must be responsible and safe. Do not submit content that shows misuse of equipment, dangerous setups, unsafe resistance band use, inappropriate supervision of minors, excessive loading, or use contrary to the product instructions. TRAINTORQUIX may remove or decline content that could encourage injury or unsafe use.

12. Social Media Tags, Mentions and Hashtags

If you tag TRAINTORQUIX, mention our brand, use our branded hashtags, respond to our request for permission, or otherwise submit content through social media, we may contact you to request permission to use your content. If you respond positively, use an agreed permission hashtag, or otherwise clearly authorise use, the licence in this Policy will apply.

13. AI-Generated or Edited Content

If your submitted content is generated, materially edited or enhanced using artificial intelligence tools, you should disclose this where the content could mislead customers. Do not submit AI-generated reviews, fabricated product experiences, fake before-and-after results, fake customer identities or content that falsely appears to show real use of a product.

14. Moderation and Removal

TRAINTORQUIX may monitor, moderate, edit, reject, disable or remove UGC at any time, with or without notice, where we consider it necessary to protect customers, comply with law, protect our brand, prevent fraud, or enforce this Policy. We are not required to monitor all content and are not responsible for every statement made by users.

15. Takedown Requests and Withdrawal of Permission

You may ask us to remove your UGC from future use by contacting us at info@traintorquix.com. We will review reasonable requests and remove the content from channels under our direct control where practical. Content may remain in archived materials, previously distributed advertising, screenshots, cached pages, marketplace records, reposts by third parties or materials already produced before your request.

16. Copyright Complaints and DMCA Notices

If you believe content on a TRAINTORQUIX channel infringes your copyright, you may submit a notice to info@traintorquix.com with enough information for us to identify the content and assess the complaint. U.S. copyright complaints should include the information generally required under the Digital Millennium Copyright Act, including identification of the copyrighted work, the allegedly infringing material, your contact details, a good-faith statement, a statement made under penalty of perjury that the information is accurate, and your physical or electronic signature.

17. Counter-Notification

If your content is removed because of a copyright complaint and you believe it was removed by mistake, you may contact us with a counter-notification. We may require information reasonably necessary to assess the matter and may restore or continue removing content depending on the circumstances and applicable law.

18. Privacy and Personal Information

UGC may contain personal information such as your name, image, social media handle, location, voice or likeness. We process such information in accordance with our Privacy Policy and GDPR & CCPA Policy. Do not submit another person’s personal information without permission.

19. Children and Minors

Our website and UGC features are not intended for children under 13. We do not knowingly collect UGC from children under 13. Users under the age of majority in their jurisdiction should submit content only with permission from a parent or legal guardian. Parents or guardians may contact us to request review or removal of content involving a minor.

20. Intellectual Property of TRAINTORQUIX

Nothing in this Policy gives you ownership of TRAINTORQUIX trademarks, logos, product names, product images, website content, manuals, designs or other intellectual property. You may not use TRAINTORQUIX branding in a way that suggests sponsorship, endorsement, partnership or authorisation unless we have agreed in writing.

21. Competitions, Giveaways and Promotional Submissions

UGC submitted as part of a competition, giveaway, influencer campaign, affiliate activity or promotional event may also be subject to separate rules. If there is a conflict between this Policy and specific promotion rules, the specific promotion rules will apply for that promotion.

22. Indemnity

To the fullest extent permitted by law, you agree to be responsible for claims, losses, damages, liabilities, costs and expenses arising from your UGC, your breach of this Policy, or your infringement of another person’s rights. This does not limit any rights you may have under mandatory consumer protection laws.

23. Limitation of Liability

TRAINTORQUIX is not responsible for user statements, opinions, claims, advice or content submitted by third parties. We do not guarantee that UGC is accurate, complete, safe, current or suitable for your needs. Nothing in this Policy excludes liability where exclusion is prohibited by applicable law.

24. International Users

This Policy is intended to apply to customers and users in the United States, United Kingdom, European Union, Canada, Australia and the rest of the world. Some rights and obligations may vary depending on your location and mandatory local law.

25. Changes to this Policy

We may update this Policy from time to time. The updated version will apply from the date it is posted on our website unless stated otherwise.
